The Will of

Elizabeth WALTER (?-1779)

This is the Last Will and Testament of me Elizabeth Walter of Horsham in the County of Sussex Widow made this Twenty Sixth Day of January in the year of our Lord One Thousand Seven hundred and Seventy Nine as follows (that is to say) Imprimis I Will order and direct that all my Just debts funeral Expences and probate of this my last Will and Testament be fully paid and Satisfyed by my Executors hereinafter named Item I give and devise unto my Son Edward Walter and my Son in Law Edward Dubbins of Horsham aforesaid Surgeon and their heirs All that my Messuage or Tenement garden backside and premises thereunto belonging situate in the West in the Borough aforesaid of Horsham late in my own Occupation but now in the Tenure or Occupation of Henery Tillary his undertenants and Assigns To hold to them the said Edward Walter and Edward Dubbins their heirs and Assigns to be by him or tham sold and disposed for the purpose of defraying the Charges and Expences of a Certain Suit now pending in His Majestys High Court of Chancery between me the Complainant and Joseph Garener and Margaret his Wife William Greenfield and Henry Griffiths Defendants Provided always and I do hereby declare that my Will and meaning is that the residue and remainder of the money arising by Sale of the said Messuage or Tenement and premises (if any there be) after payment and Satisfaction of all Charges and Expences concerning the said Suit as aforesaid shall be Equally divided Between the said Edward Dubbins and Ann his Wife or the Survivor of them and the Executors and Administrators of such Survivor and my Son the said Edward Walter and his heirs as Tenants in Common and not as Joint Tenants And which I do hereby give and bequeath to them accordingly But in case it shall not be necessary to sell the said Messuage or Tenement and Premises to defray the Charges of the said suit as aforesaid Then and in such case I do hereby give and devise the same and every part thereof unto the said Edward Walter and Edward Dubbins and their heirs To hold to them the said Edward Walter and Edward Dubbins their heirs and Assigns forever Item I give and bequeath unto my eldest Son John Walter the sum of Ten Pounds Seven Shillings and Six pence Which he owes me and for Which I have his note of hand and Which I desire may be delivered up to him immediately after my decease Item I give and bequeath unto my daughter Sarah the Wife of Thomas Lavey of Horsham aforesaid Cordwainer One plain Gold Ring one of my Cotton Gowns Which she shall like best to have and all my plain day mobs Which I desire may be delivered to her as soon as conveniently may be after my decease Item I give and bequeath unto my daughter Mary Walter One plain Gold Ring to be delivered to her immediately after my decease Item I give and bequeath unto my Granddaughter Ann Dubbins One pair of Silver Tea Tongs Six Silver Tea spoons and a little Silver Bowl Item I give and bequeath to my Granddaughter Elizabeth Dubbins One Ring the Stones set in the fform of a Star Which hath been called a diamond Ring Item as to all the rest residue and remainder of my Estate and Effects Whatsoever and wheresoever both real and personal I give devise and bequeath the same and every part thereof unto my Daughter Ann the Wife of the said Edward Dubbins To hold to her her heirs Executors and Assigns And Lastly I do hereby Nominate Constitute and Appoint the said Edward Dubbins Sole Executor of this my last Will and Testament hereby revoking and making void all former and other Will or Wills by me at any time heretofore made and declare this and this only to be my last Will and Testament In Witness whereof I have set my hand and Seal the Day and year first above written Elizth Walter
