The Will of
Peter AYLING
(1717-1771)

In the Name of God Amen I
Peter Ayling of Treyford in the County of Sussex yeoman
being sick and weak in Body but of Sound and --- mind Memord and understand
thanks be to God for the same Do publish and Declare this to be my last Will
and Testament in manner and form following (that is to say) First I
Will and disire that all my Just Debts adn funeral Expenses be fully paid
and satisfied Also I give and devise all those two pieces or
parcels of coppice lands or --- commonly called or known by the names of the
Mill Coppice and ---als Coppice containing together by Estimation three
acres (be the same more or less) situate lying and being in the parish of
Treyford aforesaid and now in my ow possession and also all those two pieces
or parcels of meadow land commonly called or known by the several names of
Brownsland Orchard and Mill ---dron ---ing together by Estimation one acre
and fifty perches (be the same more or less) Situate lying and being in the
parish of Treyford aforesaid and now also in my own possession unto my
Brother Thomas Ayling his heirs and Assigns To hold unto my
said Brother Thomas Ayling his heirs and Assigns forever
Also I give and bequeath unto my Nephew James Burton
son of my Sister Elizabeth Burton the sum of One hundred
and fifty pounds of lawful money of Great Britain to be paid within twelve
months next after my Decease Also I will and devise that my
Executor hereinafter named do and shall so soon as conveniently may be after
my Decease place at interest the sum of One hundred and fifty pounds of like
lawful money and do and shall permit and suffer my niece Elizabeth
Tribe wife of Richard Tribe and Daughter of my
said sister Elizabeth Burton to have receieve and --- the
--- and --- thereof for and during the term of her natural life and from and
Immediately after her Decease I Give and bequeath the said sum of One and
hundred fifty pounds so to be placed out at Interest as aforesaid unto and
amongst all the every the child and children of the said Elizabeth
Tribe that shall be alive Also I Give and bequeath unto my
Sister Mary wife of William Collins the
sum of One hundred pounds of lawfull money to Great Britain to be paid
within twelve Months next after my Decease Also I Give and bequeath
unto my sister Elizabeth Burton One Annuity or yearly sum
of Twelve pounds of lawful money of Great Britain and during the term of her
natural life to be paid her byanual half yearly payments the first payment
thereof to begin and be made within Six Calendar months next after my
Decease Also I Give and bequeath unto my Sister Johanna
Tribe one Annuity or yearly Sum of Twelve pounds of like lawful
money for and During the term of her natural life to be paid her by equal
half yearly payments the first payment thereof to begin and be made within
Six Calendar months next after my Decease [the next five lines are

Richard Ayling son of my late Brother Robert Ayling
the sum of five pounds to be paid within twelve months next after my Decease
Also all the rest and residue and remainder of my Estate and
Estates but --- and personal of what nature kind or quality soever within
the Kingdom of Great Britain or also where I Give devise and bequeath unto
my said Brother Thomas Ayling his heirs Executors and
Admons and if my personal Estate shall not be sufficient to pay my Debts
Annuities and Legacies and Funeral Expenses Then I Do hereby charge my said
coppice and lands with the payment of so much thereof as the same shall fall
short to pay And I do hereby make and constitute and appoint my
said Brother Thomas Ayling whole and sole Executor of this
my last will hereby revoking all former wills by me and any unto heretofore
made in witness whereof I the said Peter Ayling the
testator to this my will have set my hand and seal and have published and
decaled the same to be my last will and Testament the tenth Day of June in
the year of our Lord One Thousand Seven hundred and Seventy one
Peter Ayling signed sealed published and declared by the said
Peter Ayling the testator as and for his last will and
testament in the presence of us who in his presence at his request and in
the presence of each other have subscribed our names as witnesses there unto
Mary Durman, Thomas Williams, Richard
Andrews
This Will was proved at London on the Twentieth Day of July in the year of
our Lord One thousand and Seven hundred and Seventy one before the Knight
Worshipful George May Doctor of Laws Master Keeper of
Commissions of the Prorogative Court of Canterbury lawfully constituted by
the oath of Thomas Aylwin otherwise Ayling
the Brother of the deceased and sole executor named in the said will to whom
administration was granted of all and singular the Goods Chattels and
Credits of the said --- have been fully sworn by commission duly to
administer
